Creator Terms of Service
01 Acceptance of Terms
By creating a creator account on HYPERFLEX ("Platform"), you ("Creator") agree to be bound by these Creator Terms of Service ("Terms"). If you do not agree, do not create an account.
HYPERFLEX is operated as infrastructure only. We provide the technical platform for you to create and manage prediction markets for your community. We do not operate, manage, or supervise individual markets.
02 Infrastructure-Only Model
HYPERFLEX is infrastructure, not an operator. Like Shopify or Substack, we provide tools — you run your community. This means:
- HYPERFLEX does not create, manage, or resolve any markets on your behalf
- HYPERFLEX does not guarantee the accuracy of any market resolution
- HYPERFLEX is not a counterparty to any prediction made by your community members
- All markets on your community page are your sole responsibility
03 Creator Responsibilities
By using HYPERFLEX, you agree that you are solely responsible for:
3.1 Market Creation
- Writing clear, unambiguous market questions with objectively verifiable YES/NO outcomes
- Selecting appropriate resolution sources (minimum 3 sources required)
- Setting realistic resolution dates
- Ensuring markets comply with all applicable laws in your jurisdiction
3.2 Market Resolution
- Resolving all markets accurately and fairly on or before the resolution date
- Using only the resolution sources specified at market creation
- Providing honest attestation when confirming resolution outcomes
- Resolving disputed markets in good faith
3.3 Community Management
- Communicating clearly with your community about market rules and resolution criteria
- Handling community disputes related to your markets
- Maintaining the trust of your audience
04 Prohibited Markets
You may not create markets involving:
- Assassinations, targeted violence, or physical harm to individuals
- Illegal activities of any kind
- Markets that constitute unlicensed gambling under applicable law
- Markets targeting minors
- Markets designed to manipulate financial instruments
- Markets that could be construed as regulated financial derivatives without proper licensing
- Any content prohibited by CFTC regulations or applicable financial law
- Markets based on private, non-public information
HYPERFLEX reserves the right to remove any market that violates these prohibitions without notice.
05 Points System
HYPERFLEX markets use play-money Flex Points, not real currency. By default:
- Flex Points have no real-world monetary value
- Flex Points cannot be exchanged for cash on the HYPERFLEX platform
- Any rewards or benefits you offer in exchange for Flex Points are your sole responsibility
- You are responsible for ensuring any rewards you offer comply with applicable laws
06 Resolution Attestation
When resolving a market, you are required to attest:
"I attest that this resolution is correct and fair, based on publicly available information consistent with the resolution sources."
This attestation is binding. Knowingly false attestations may result in account termination and may expose you to legal liability from your community members.
07 CFTC and Regulatory Compliance
HYPERFLEX operates as a software infrastructure provider. You, as Creator, are responsible for ensuring your use of HYPERFLEX complies with:
- Commodity Futures Trading Commission (CFTC) regulations
- All applicable state and federal laws in your jurisdiction
- All applicable laws in the jurisdictions of your community members
HYPERFLEX makes no representations about the regulatory status of prediction markets in your jurisdiction. You should consult legal counsel before launching markets in regulated categories (politics, finance, crypto).
08 Liability Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- HYPERFLEX SHALL NOT BE LIABLE FOR ANY DISPUTES BETWEEN YOU AND YOUR COMMUNITY MEMBERS
- HYPERFLEX SHALL NOT BE LIABLE FOR ANY INCORRECT OR DISPUTED MARKET RESOLUTIONS
- HYPERFLEX SHALL NOT BE LIABLE FOR ANY REGULATORY ACTION TAKEN AGAINST YOU FOR YOUR USE OF THE PLATFORM
- HYPERFLEX'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO HYPERFLEX IN THE 12 MONTHS PRECEDING ANY CLAIM
09 Indemnification
You agree to indemnify, defend, and hold harmless HYPERFLEX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your markets or resolutions
- Your community members' disputes
- Your violation of these Terms
- Your violation of any applicable law
10 Account Termination
HYPERFLEX may terminate your account for:
- Violation of these Terms
- Creation of prohibited markets
- False attestations on market resolutions
- Repeated community complaints
- Any activity that exposes HYPERFLEX to legal risk
11 Changes to Terms
HYPERFLEX reserves the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms.
12 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
